Agreement to Terms

By accessing or using GiveBAC's mobile application and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

Eligibility

• You must be at least 18 years old to use GiveBAC
• You must be a U.S. resident with a valid Social Security Number
• You must have a valid email address and phone number
• You must not be on any prohibited party lists or sanctions programs

GiveBAC Virtual Card Program

Card Issuance

• Cards are issued subject to identity verification and approval
• We reserve the right to deny card applications
• Cards are for personal use only, not commercial purposes
• You are responsible for all authorized and unauthorized transactions

Round-Up Donations

• How It Works: Purchases are rounded up to the nearest dollar; the difference is donated
• Authorization: You authorize us to debit your linked payment method for round-up amounts
• Donation Limits: You can set monthly donation limits in your account settings
• Charity Selection: You choose which verified charities receive your donations
• Timing: Donations are collected and transferred to charities weekly
• Tax Deductibility: Donations may be tax-deductible; consult your tax advisor

User Responsibilities

• Account Security: Keep your login credentials confidential
• Card Security: Protect your virtual card information; report lost/stolen cards immediately
• Accurate Information: Provide truthful and current information
• Compliance: Use Services in accordance with all applicable laws
• Prohibited Activities: No fraud, money laundering, or illegal transactions

Fees and Charges

• No Monthly Fees: GiveBAC does not charge monthly account fees
• No Transaction Fees: We do not charge fees for card usage
• Donation Processing: 100% of your round-ups go to charities (we absorb processing fees)
• Third-Party Fees: Your bank may charge fees for declined transactions or insufficient funds

Disputes and Chargebacks

For transaction disputes:

• Contact us within 60 days of the transaction
• Provide transaction details and reason for dispute
• We will investigate and respond within 10 business days
• Donations are final and non-refundable once transferred to charities

Termination

You may close your account at any time through the app. We may suspend or terminate your account if:

• You violate these Terms
• Fraudulent or suspicious activity is detected
• Required by law or regulatory authorities
• Your account is inactive for more than 12 months

Limitation of Liability

To the maximum extent permitted by law, GiveBAC shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount of donations you made in the past 12 months.

Dispute Resolution

Arbitration: Any disputes will be resolved through binding arbitration rather than court proceedings, except where prohibited by law. You waive your right to participate in class action lawsuits.

Governing Law

These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict of law principles.
